The Port Authority of New York and New Jersey- Privilege Permit and Access Fee Required- as of April 5, 2021
As you likely already know, as of April 5, 2021, the Port Authority of NY and NJ is initiating a requirement for all For-Hire Vehicle Bases to have a Privilege Permit issued by the Port Authority to pick up and drop off passengers at any of the 3 local Port Authority airports. As required by that Permit, a fee must be collected from the customer and remitted to the Port Authority on a monthly basis, along with certain reporting requirements detailed in the permit.
You must get a Permit for each base that will be picking up and/or dropping off passengers at any one of the 3 Port Authority airports (EWR, LGA, JFK).

General Instructions re Port Authority Privilege Permit
1. Fill out the document entitled “Instructions and Required Documents for For-Hire-Vehicle (FHV) Permit”;
2. You will need a separate application for each base you own.
3. Initial Info;
a. The Permittee Rep:
b. Tax ID: different EIN for each base;
c. Projected # of trips for each base;
4. Operating Agreement- In the event that your company is an LLC and does not have an Operating Agreement, as is required by Section 3(b) of the Instructions, attached is a form that may be used as an alternative. See Unanimous Written Consent of All of the Members
5. W-9 (see attached). you need a separate W9 form for every base that applies for a permit;
6. Security Deposit- Equal to the estimated Access Fees for Three (3) Months of Projected Operations (Airport trips- only for EWR, JFK, and LGA) ;
7. List of all affiliated vehicles license plates and all operator names;
8. Security deposit;
a. a check in the amount of the estimated Access Fees for Three (3) Months of Projected Operations;
b. Make check payable to “The Port Authority of New York and New Jersey”;
c. Address: THE PORT AUTHORITY OF NEW YORK AND NEW JERSEY P.O. BOX 95000-1556 PHILADELPHIA, PENNSYLVANIA 19195-0001 ;
9. Certificate of Insurance- you will need this for each base that is applying
Things to keep in mind moving forward
1. Para 6- there is NO initial fee. See #1 and #4 of the Rider which exempts liveries
2. The fee (Section 9(b)- it is $2.50 for each airport pick up and 2.50 for each airport pick drop off
a. This only applies to EWR, LGA, and JFK
b. The fee is added to the charges to the customer (just like the congestion fee)
3. Section 4(i)- Waybill- see the rider for the information for what each FHV Driver must possess in paper or electronic equivalent, which shall include the following information for each Pre-Arranged Trip
4. Monthly Payments- See Section 9(c) which details the monies owed on a monthly basis…and this payment must also include monthly reports
5. Monthly Reporting- See Section 12 which details the reports that must be provided on a monthly basis
MONTHLY REPORTING- Eventually the Port Authority will have a dedicated website by which to upload your monthly reports. Until such time, the Port Authority has advised us that all permittees are to use a temporary template for the reporting of trips to and from the Port Authority Airports. Also, until the dedicated website is operational, please send the completed monthly report back to the Port Authority at the following email address: PermitFHV@panynj.gov. The fees due each month should be sent to the Port Authority Lock box as indicated in the Permit.
